This year I have been blessed with 8 wonderful children on my caseload. Three of these are not districted for my school and have recieved special permission to bin my class. I am getting a new student on Monday after Spring Break (yes, only 30 days are left)which will bring my number up to 9. My capacity limit is 11. If I recieve 3-5 more students that are districted for my school will by 3 that are not be forced to leave? I hope not, but what happens? I have asked my Special Ed boss and have recieved no answer as well as the school counselor. Any thoughts?

I suppose it depends on what the other schools look like. But if you are okay with having 15 students and no one else makes a fuss, it is unlikely they will force the issue. You become more of a bargain!
The size limits are a matter of safety, IMHO, with students with severe disabilities. In my setting, 7 feels like an overload, but 4 of them are wheelchairs requiring a lot of 1:1 feeding/toileting. It gets difficult to handle and move for tornado/fire drills or even just lunch.
I've also gotten students in April/May before and most of them seem to move again before the fall. It involves a lot of work in a hurry for an IEP with not a lot of information to go on.
